i am an nri once if i receive the divorce papers from family court by my wife and if i am not appearing in the family court,what will be the judgement.if i am not receiving my divorce papers and sending back with an endorsement saying out of station ,what will be the procedure.if she gets exparte divorce based on cruelty will it affect my 498a proceedings weeker

It is better that you appear and contest the allegations of cruelty.

Dear anonymous,after receiving the divorce paper fom the court,if you do not appear and contest the case, definitely it will be decided ex-party and in favor of your wife.Regarding 498a proceeding,its depend facts and circumstances of each case.In your matter it may weak your case u/s 498a.

if u r not contesting divorce case that means u r admitting her case. allegations of cruelty r proved.498A will b affected thereby. better u contest divorce and prove no cruelty from ur side.
