Querist : Anonymous (Querist) 23 July 2010 This query is : Resolved
dear sir
it is a criminal case
pending for last 3 years
complaint person as came for compromise what is the procedure to follow
is is a 420 cheating case by a person
Devajyoti Barman (Expert) 23 July 2010
If the offence is compoundable then simply file a compromise petition in the court.
If it is not then either you have to wait till the judge pass the judgement on the basis of testimony of all witnesses or get the case quashed from the high court.
Another option is to get the case dismissed fro default if it is a complaint case u/s 200 of CrPC.

Sir, a S. 200 CrPC case can't be dismissed in default however it can be quashed and or rightly said if proposed offence are compundable then compromise application could be considered accordingly.

I say this from experience; unknowingly a person filed two S. 200 CrPC cases in two district courts from last several years and he is chasing only one S. 200 CrPC Complaint case and another one is dormant like he gets to hear always next date of hearing being given from last several years and he is not even appearing in one complaint case which he himself has filed.
