Service of Documents

Querist : Anonymous (Querist) 01 October 2010 This query is : Resolved
If a document to be served on a company, is returned with the remark "left", is that a valid service? The letter was sent to the registered office of the company. No other remark was made. Any inputs on this matter would be appreciated
R.Ramachandran (Expert) 01 October 2010
Dear Anonymous,
Please be clear whether the document is to be served on the "Company" or any person employed/working in the company. Why I am asking is in regard to Company, if they had shifted normally the remark would be "Shifted". In case of any person left the company then the remark would be "Left". The remark "Left" to a company seems highly improbable and out of the ordinary.
In either of the cases, if the post is returned undelivered with the remarks "Left", it only means that the service has not taken place. By no stretch of imagination it can be said that there is a valid service.

Thank you For you inputs Mr. Ramachandran. The document is indeed to be served on the company and the remark was "left". The Registered Office of the company also has not changed. Hence the confusion!

Get the strong address proof of company and file a consumer complaint against post office.

Make an affidavit that the said address is only known address and ask for paper publication.
