judgement day

Querist : Anonymous (Querist) 27 December 2010 This query is : Resolved
i am complainant of a 138 n.i.act case and on the date of Judgement the accused didn't turned up, magistrate ask surety to produce on the next day. what happen if the accused didnt turned up on that day.
adv. rajeev ( rajoo ) (Expert) 27 December 2010
I think it is not judgment day, court might have granted a bail and next day it might be for the providing surety. If I am right and surety didn't turn up then He will be behind the bars, till providing the surety.
If it was judgment day court cannot direct the accused to provide the surety on the next day because after the pronuncement of the judgement accused will be taken to the custody

If the accused does not turn up,the sureties will be in the soup.
Advocate. Arunagiri (Expert) 27 December 2010
I agree with Mr.subramanian.

AGREED WITHABOVE. BESIDE THIS THE ACCUSED CAN BE BOOKED U/S 174-A BY THE COURT.
Arun Kumar Bhagat (Expert) 27 December 2010
I differ with all views. Warrant of Arrest against the accused shall be issued and proceedings under section 446A Cr. P.C shall be started against the surety.
