JV between the builder and land owner. Ratio 60:40. POA given to Builder. Builder sold 80% fraudulently.

Is it a civil case or criminal case?

You can file both civil and criminal, in criminal their will be no compensation.

Prima facie it is civil dispute.

If the case is booked u/s 420 ipc, whether the new buyer can also be arrayed as an accused.
