Remaining Salary not paid after termination

Querist : Anonymous (Querist) 26 July 2011 This query is : Resolved
I was working with Ismoip Services Inc.The company outsources their work to India and is operated by Harman Bajwa and Pooja Mehra. I was working as a content writer for them. After 4 months of my hard work and completing their lined projects they ripped-off their connections from India saying my deliveries were not up to the mark. The company still owns my two months due salary which they are denying to pay back.
After referring a post in consumer complaints they are saying that they submitted a circular against me to all prominent job sites that I copy the content and harass company's client. And are saying that this circular will be forwarded to all web design companies guiding them not to hire a person like me.
And also threatening to put a defamation charge against me.
What should be my step against them as the company is in Canada, Vancouver and I am in India,Delhi.

Serve a legal notice from your lawyer and threaten them to initiate legal action including filing of defamation suit if they perform their proposed action.

But how can i serve a legal notice from India to Canada. And i dont have any legal appointment documents of the company apart from work conversations in email formats. Will that be enough?

If you like and only if convinced with their services, you can use services of Internet Arbitration, a small claims court at Internet. It is in the State of Georgia, USA and takes up inter-country arbitration cases pertaining to various countries for online jobs. You may check details and fee, etc., at the following site:
http://net-arb.com/

Of course, it all depends if both the parties agree for arbitration through the said organization.

You may also make search on the internet, if the contents provided by you have been used by any party, as the copyright would not stand transferred to the employer unless you are paid for hire to work basis. In that case you can sue even in India the both parties, your employer as well as the party using your contents.

File a civil suit after obtaining where-abouts of defendants.
