Tenant under rent control act

Querist : Anonymous (Querist) 28 July 2011 This query is : Resolved
i have a tenant since past 30 years. she pays a rent of 3100 since last 15 years and used to pay 500 before 1996. Is there any procedure by which i can evict her. the personal need n other ways under rent control act do not qualify in my case.

if i cannot evict her, can i legally get the marker rent, which is around 40000?

You can approach the civil for revising the rent, for eviction etc.

GENERALLY personal need is a ground ,found every where.

Personal Bonafide Necessity,Default in payment of rent,Sub-letting, Nuisance,material-Alteration and Non user of rented premises are general grounds on which tenant can be evicted.almost in every state rent control act there is Provision for revision in rent so contact to local lawyer.

Unless you can prove that your hardships will be more than the tenant , no eviction possible under any Rent act in any State.
