Father's property

Querist : Anonymous (Querist) 09 September 2011 This query is : Resolved
Hi,

I stay in my fathers's house & my father is still alive. Now due to various family confilcts, Can I ask for a share of my fathers property to move out. I have helped my brother & father in the same building with finance for expansion, renovation & further construction on the same building. Am I legally eligible to ask my father for part of his property. My father says that he shall give me anything in his property. The property is in my fathers name.
Kindly advice.

Please clear the meaning of "I have helped my brother & father in the same building with finance for expansion, renovation & further construction on the same building" and please provide the information regarding the Ownership of the Flat and I also agree with R.Ramachandran Sir.

As only your father is the owner of this property though you may also have incurred a lot of amount on renovation and maintenance but still the status of the property has not changed. You all have a HUF and if this HUF is now divided, you are fully entitled to share therein legally. You may file a civil suit if you become unable to get any share as you have also contributed in the family. Your father is only Karta of HUF and has no exclusive ownership.
