Harassment of familymember by shopkeeper

Dear sir,
while parking private car at roadside common
parking place one shopkeeper objected using
the pretext of being owner of the pace.he
abused & threatened my wife,daughter & son.my
family called the police .police came and
asked us to report to police station.we lodged written complaints against the shopkeeper.next day we met the police
told for compromise.we did not agree.he also complained stating that my family threatened
him.I think he might have bribed the police.
so police is favouring him ignoring the fact.
monday is next meeting with police.what I should do now?

Ask the Police to register FIR against them. If police falters then move the magistrate u/s 156(3) crpc.

Lodge a diary to police, if the police authority ignore this then file a Writ Petition under article 226 of Indian Constitution in High Court for inaction of Police authority.

Mr Barman is absolutely right. The Police cannot compel you to compromise the case. He is bound to register the FIR. In case he fails to do so, you can always approach the Court u/s 156(3).

I advise to settle the matter through compromise.
eventhough law is in your side,you have to waste years and years before something come out of such cases.
Disclaimer: I am not a lawyer and stating the above based on practical experience,as the real punishment is to the petitioner by way of indefenite trials and postponement.

Dear experts,
Ref my query on 10/9/11.subject as mentioned.thanks for your valuable opinions but there is a little doubt-when asked for FIR police
people told that he has also given written complaints stating that my family members
also threatened him so police has to listen
to him also so they have to apply 107 & produce us also in front of magistrate.I am
confused by this remarks of police.please
advice.Regards.

File a complaint in court without fear of shopkeeper's complaint.

First inform where are you,the state and the city,so can understand the quality of the Police,first.
The second get proper information,whether the developer had sold the space to the shopkeeper?
