This query is : Resolved
My Grandma, Father, his brother and four of my aunts(sisters of my father) are legal heirs of a property my father expired and we the sons are facing serious financial problems due to his unexpected expiry ...... We including the other aunts are ready for disposal of the asset as they were in same need as we are..... my Grandma is 87 years even she was willing to dispose the asset and distribute their respective shares but now my uncle(father bother) has taken my grandma with him and he is some have playing a double game saying sometimes he will sell off the property and give out all their shares and sometimes not and sometime he is ready to buy that asset and settle by paying us.........this story was being played since my father was alive in 2006 he was paralysed in 2004 and expired in 2008 and till now nothing happened ............
This is the fact the property value is 2.04 crores are per municipal value its market value is 2.5-3 crores
Now my query is can i file a police complaint on him for all his mischieves in not selling the property do we have such a legal right and stance on our side my aunts will also support as they are also willing to take their respective shares in selling the asset
Can any one suggest me any better idea to solve this
My mom was also not feeeling well i need money for her medication and also to clear my debts i lost my father and dont want to loose anyone more from my family ....... I will get 2,50,00,000/9 = 27,00,000 as my share how to acquire this please guide me anyone ........

If you can sell the property when divided then file case of suit for partition and together with your aunts and after getting directions you can sell the property clearly.

Dear karthik, just appoint an advocate, and file a partition suit for claim your father's share.. And whats your calculation, if i am right mean you are entitled to claim 1/7th of your father's share. Its will be divide between your father's legal heirs.

Dear Karthik,
I am agree with ADV.Tom. But i will advice you before going legal, do the last discussion with your uncle (father's brother) with all that heirs who want to sell the property and want to take their share.

You have to file a suit for partition, only then your uncle will come to terms. Otherwise not.
