I HAVE APPLIED FOR REGISTRATION OF A MARK IN THE TRADEMARK REGISTRY ON BEHALF OF APPLICANT. MY APPLICATION IS PENDING. NOW OUR GOVERNTMENT HAS DECIDED TO USE AND REGISTER THAT MARK WHICH I PROPOSE TO REGISTER . HOW SHALL I DEAL WITH THIS????????

If your mark has been accepted to be regisered, you shall be intimated accordingly and thereafter you may use as desired.

It does not appear that the trade mark applied for has been accepted to be registered.
More over, it is also not clear whether it is a unique mark freely available for registration.

first let me know what is the "Search & Examination" report says??
Is there any Objection u/s 11 of TM Act 1999 or weather its on "Opposition" Stage or anything else!! if there is Objection then u have to file ur reply of the same in order to remove the said objection. or anything else, then u first tell me the entire details including Application no. to me.

government symbols can not be registered as trademark for a business concern. However your query is incomplete in the sense that you have not told the stage of your application,nor the mark applied for,hence it is difficult for us to guide you properly.
