Transfer

(Querist) 05 October 2011 This query is : Resolved 
sir,

in the year of 2007 company trasferred one employee from bangalore to chennai (the head office ) in bangalore brach 7 employee were working in chennai head office 20 employees were working .
that perticular employee after trasfer not joined in chennai brach now in 2011 he file raise dispute4 before labour officer bangaore ,and in prayer portion he asked backwages ,

what company can do now ,

his reason for tranfer is lost of confidence , this is export company along with other same company he started new bussines ,

now what company can do please advice

A company has well good a purse to engage a lawyer for the purpose and it would be in interest of the company to conference the mater with a lawyer on one to one basis.

we do not prefer to answer those who are able to pay a consultant.

This is very simple question. Such employee has got got no right to raise any industrial dispute before labour court at such belated stage. Where was he during these 4 years?

As per facts of query, he was asked to join at Chennai and he didn't do it so he has got no right to knock the doors of any court. The courts are not meant to help a wrong doer. Transfer is a valid right with the employer and none can challenge it. The case is merit-less.

Engage a lawyer and defend the case as per your facts.

@Mr.Makkad i think we should have some accord
in this sphere whether we need to answer or not such a query otherwise to discriminate a few denying answers and favor a few with answers would not be called a good practice on our part.
