I am a Complainant in fraud, forgery and cheating case.
in the last date when I informed Honorable Magistrate Saheb that accused are not coming the Honorable Magistrate Saheb told me that I do not require to come to the Court. I will be sent Summons and then I am required to appear before the Hon Court.
I would like to know from the Experts that Can I attend the Court on the next dates without summons from the Court?

In state case, the status of the Complainant i.e. defacto, is of a witness. Prosecuting agency is the State which conducts proceedings through Public Prosecutor. Since your interest is involved in this case you can engage your private advocate who shall help the prosecution and keep a watch against common misdoings. Magistrate rightly advised you.

If it is a complaint case filed by you in that event you are liable to attend the court on the date fixed unless you are concesstioned by the Learned Court in writing.
