New documents during cross

Querist : Anonymous (Querist) 11 November 2011 This query is : Resolved
Counsels,

Wife has marked documents. If husband has to confront the wife with new documents during cross examination is it mandatory to mark those documents in favor of husband prior to cross examination.

Thanks in advance.

As per o.xiii(3)(a) you have to produce them at the time of cross examination and not before that.
Devajyoti Barman (Expert) 11 November 2011
No ,you need not.
If the same is admitted then it would be marked or else the husband will have to prove it.
prabhakar singh (Expert) 11 November 2011
If the purpose is restricted to confrontation only then you need not.

You don't need to exhibit them.

You can mark those documents through the witness while continuing your cross examination.
