Counsels,
Wife has marked documents. If husband has to confront the wife with new documents during cross examination is it mandatory to mark those documents in favor of husband prior to cross examination.

As per o.xiii(3)(a) you have to produce them at the time of cross examination and not before that.

No ,you need not. If the same is admitted then it would be marked or else the husband will have to prove it.

If the purpose is restricted to confrontation only then you need not.

Cross examination can only be done on proved documents.

You can mark those documents through the witness while continuing your cross examination.

Dear Arun Kumar, I am not clear, what do you mean by corss ccan be done based on prvoed documents. does that mean I need to mark them prior to cross examination. Should there be a prior notice the person to be corss exmianed.
