Transfer a partition suit, cpc 24

In one partition suit, the toatl property value is 35lakh, i claim for my part which is 1/6, the suit is in Additional civil judge, Nadiad. now the question aries for pecunary jurisdiction,and the cort ask me for order 10b to return the plaint and go for proper court.I request to court,that court him self transfer the suit to civil ragistrar back or principl senior civil court which is also in same district and same building.U/s cpc 24(5), but court says that they not transfer the suit,to ragistrar or principal judge. what i do?

No issue when the court returns the plaint you just take delivery of the same and file the same copy to the proper court.

You need no separate court fees or petitions to be submitted in the transferee court.
