I have applied for divorce and still not got divorce. I have two houses in my name (self earned)and another house owned jointly by me and my husband.
I want to make my children to be the full owners of the two houses after my death and half owners of joint property.
can i write a will or what i should do?
here i would like to mention that my husband is a lawyer and he is trying his level best to see that my divorce petition is postponed. On the contrary he is married and having a child from the wedlock. my fear is that i may die before my divorce.
hence seeking your advice to safeguard the property

Yes you can very much execute Will in your lifetime giving your share in the property to any person/s you wish.
If your divorce suit is pending for sometime without much headway then file application under Article 227 of the Constitution in the High Court for expeditious hearing of the case.
No special safe guard opf the house is required.

I advise you to execute a registered gift deed in favour of your children as soon as possible against your entire share in the mentioned properties because various ifs and buts are connected with the will and the same can even be got challenged at later stage. so there is no use to defer your decision and see it implemented during your life time.
