Change in board of trutees of the charitable trust formed by family members

Querist : Anonymous (Querist) 24 January 2012 This query is : Resolved
My query is - We have formed a charitable trust by our family. Initially the board of trustees comprised of members of our family. Few trustees of our trust have died of old age. The remianing board of trutees are not willing to induct new members of our family into the board of trustees. Please advise can the survivors of died trustees claim for the change in board of trustees.

Minimum no of trustees has to be maintained as per your state laws but not a heredity right to be replaced.

Survivors of dead trustess cannot claim change unless they are authorised so by the trust deed, any ways without perusing the entire deed it is difficult to advise properly. Hence contact a local advocate dealing in such matters.

Check trust deed. you have to adhere the bye-laws of trust deed. Merely on will of some one, can't go further.

It all depends upon how the deed was drafted.
