Dear Sirs,
In a duly registered lease deed of a premises there is a clause that all taxes including service tax and levy relating to the property has to be borne by the lessor.
Lessor is depositing the service tax without obtaining it from the Lessee for more than a year.
Service tax according to me is an indiret tax and same has to be deposited by the lessor but its liability(Servive Tax)rests on lessee.
Query:- can a lessor claim payment of service tax from the lessee when he had already entered into a contract(lease deed) with free concent and waive his right to claim it from the lessee?
