Release from ulc

(Querist) 03 March 2012 This query is : Resolved 
• The Total Land in Block No XX TSR No XXXX Covered 58 Acres as per the Document XXX/1887 is purchased by Parla Sattayya Satti, Vizianagaram Zamindars from Mosalaganti Zamindars of Allipuram of Visakhapatnum
• Mr Chintakayala Thammayya Naidu, taken Lease for 99 yrs(SashwittaKovvlu) from Parla Narayana Satti,S/o Parla Sattayya Satti as per the Document No XXX/1897
• Mr Chintakayala Thammayya Naidu, hiding the registered Lease deed and manipulated records, entered his name in settlement records for 35 Acres, TSR Records and Gillman Records (1903).
• Basing on the revenue and the Gillman Records Chintakayala Thammayya Naidu sold out the land to various parties.
• For example the details is as follows of one of the purchased parties
o a) In 1920 Document No. XXX/1920 sold to Marie Shuttie.
o b) On XX-X-1920 Marie Shuttie sold to William Crawson.
o c) On XX-X-1933 William Crawson sold to Lellian Ethel Harding, document # XXX/1933.
o d) On XX-X-1934 Lellian Ethel Harding sold to Smt. Sri Ravu Venkata Subbayamma, w/o Sri Ravu Ranga Rao & D/o. Innuganti Raja Gopal Bahdur,document # XXXX/1934.



• U.L.C Department Acquired the land 10.65 Acres from Chintakayala Family.
• The U.L.C Department has not verified the records because total land belongs to Perla Sattayya,Vizianagaram Zamindars Registered Documents available in register office.
• In the meantime, the collectorate allotted some land(the above sd land) to XXXXX XXXXX for their quarters constructions, but in stipulated period the XXXXX XXXXX could not utilise it, so the collectorate cancelled the land allotment of the XXXXX XXXXX
• After the cancellation of the XXXXX XXXXX’ proposal the collectorate instructed the U.L.C dept. to handover the land to APIIC on 20-10-2004 without any requisition from APIIC
• In this regard, the collectorate and U.L.C has not gone through proper records by overlooking the document, the land was handed over to APIIC. In enquiry the APIIC has not acquired the said land but handed over by collectorate to them.
• Till date the owners of the land has not received any compensation or award from the Govt.

So is it possible to retain or release the land back from U.L.C?????Plz Elaborate the answer if it is Yes or NO and WHY...???

more than 110 years have elapsed and owners are still sleeping and are expecting that people come and return their land intact to them which is not possible at such belated stage.

Your question do not show the intension of the true owners to know the procedure to get their land back rather they first of all want assurance whether it shall be possible or not which again is a reflection that such persons have no moral right to retain their property which they can never care and depend upon others for that issue.

lease of 1897 is over in 1998.

Ask for return of land , with whatever development or buildings thereof.

File suit.
Matter is old, & complicated, need to be investigate by your local Property Lawyer.
can't solve ur problem, raising query here.

To get fortune, have to work hard, investigate and obtain documents.

Raj Kumar Makkad:::Sir, please do not take it otherwise...My Intention is to know if the true owners can get back atleast the 10.65 acres of land which the ULC has acquired... I'm not asking for the assurance.I m only trying to understand if it is a possibility to get back the land..

I have all the Supportive documentation of the above said land to Justify the RIGHT OWNERS.Including the FMB schetch,EC,Search EC and etc.,which clearly justifies the RIGHT OWNERS...

So is it possible to retain or release the land back from U.L.C?????

As no compensation has been paid by the ULC,
Owners are advised to file a writ petition directly in the High Court,which would be a better way to deal the matter than filing any civil suit.
