Dear Learned Experts,
Please give your inputs on the below issue.
One client of mine approached me with a doubt. That their organisation wants to send promotional sms to some of their client database. Some of them have adtivated Do Not Disturb, and sending promotional SMS to such number is banned by TRAI.
Now there is a practice of sending promotional SMS through forign service providers so as to keep away from TRAI norms as the same is without any trace of indian service providers.
What I want to ask is that, is there any regulation on such a practice?? I did some research with respect to the same, but i could find only that TRAI is silent about this issue.

Truely speaking TRAI has not made any regulation to deal with the foreign service providers. This issue had also been raised during Lok Sabha during winter session and many members had expressed their anguish over the interference of various foreign service providers which is also becoming a danger to Indian interests in various sectors.

Thanks for your valuable input.
Thus, it means that sending promotional sms through foreing service providers is not illegal in India for the time being.
Let us wait for the government to pass any regulation on the same.
