Govt employee once get a bail waht is the procedure to joining..

dear Seniors

Good evening to you.

sir have a query it is related to KAT (Karnataka Administrative Tribunals) one of my friend he is Govt Employee as FDA similar.
between he and his colleagues small quarrel happened in same office. and his colleagues made complaint against him in police station. then same day he got a bail.

now the question is once he get a bail he want to re-join next day. but his superior is asking on which basis i appoint to you. OR
bring any clause or reference or any authorisation ltter.

now the question is what is the procedure to joining. OR what kind of again document to produce before the superior.

Basically it is you not your freind.

If you have nor remained in custody for 48 hours you are not deemed suspended so you boss cannot stop you from joining duty. i he does so he himself is committing a misconduct. But you have to inform your department about this bail lest you commit a misconduct.

Still you cannot be denied joiing duty

Who so ever asserts must prove. It is the duty of superior of your friend to cite the relevant provisions of service law applicable to your friend that even on arrest and immediate bail matter, your friend may be treated as deemed suspended. Your friend should issue a legal notice to such officer and should claim his continuous duty in the office.
