(Querist) 09 April 2012 This query is : Resolved
I have a query.... i have produced the documents before the court and now it is the stage of exhibiting those documents. But at the time of production i had filed few xerox copies of some documents which i was not having with me as original at that point of time. however the hon'ble court says that all the documents should be exhibited at one time only as i said that please allow me to tender those documents which are produced original and later i can produce those documents which i have received as original now and is not allowing me to produce those few documents which i have recieved as original on which i am relying and the court is saying that the stage of production has passed and so now u cannot produce. please help how to proceed in this stage as the court is saying that those original documents i cannot produce now as the stage of production has passed and on the second place the court is not ready to exhibit the rest doucments which have already been produced as original before the court. Please help if any case law or what should be done to proceed in this regard?

Move an application seeking such permission and if denied, file revision before high court.

yes, Mr. Makkad is right

Rightly advised. Submit those documents along with an application. If rejected go for revision as advised.

There is amendment in the Order-XIII Rule one of the CPC w.e.from 1.07.2003 that originals shall be produced prior to settlement of issues.

Though many courts do not follow it but if other side objects than it is essential to do so which may turn the fate of the suit.
