Seller party not coming for registry

I have done a agreement with to buy a shop in rewari (haryana) in rs. 40 lac.

Agreement is done with rs. 5 lac. with date of 31 May 2011.

Amount is ready with me , Iam calling seller party for registry. But they are saying I have no time. We will meeet near last days around 31 May 2011.

He do not comes at 31 May 2011.

The cost of shop is gone to rs. 50 lac as per market value. Seller party does not seems intrested for registry.

If the seller party do not comes on 31 May 2011. what legal action I can take against him.

I am much intrested in registry not to take the double of my agreement amount.

Eperts , Please guide me, How he can be forced legaly if he does not comes on last date of agreement.

Mr. virender! Open your eyes. 2011 has crossed now. More than 11 months have crossed from the last date of registration of sale deed and till now the seller might have grasped your advance money.

your query is vague because 31 may 2012 not yet come, but acc to law if the seller party not come then you can send him notice for specific performance to registered the sale deed and after that file suit in civil court.under same act.

dont count your chickens before they are harched . wait for 31st may 2012 . if he fails to come for registration of agreement issue notice and file suit for specific performance

Agreed with shri sethi. Send notice , in advance if you so wish, to call upon him for registration on 31-5-2012. , failing which, inform him, that you will go for specific performance court case., and meanwhile ask him not to create any third party right,

Dear Sir,

Thanks for responses.

One more thing I want to clear that I have done agreement on Rs. 10/- stamp paper. taken from stamp vender.

Agreement is printed & signed by both parties with witness.

Now there is any other fomality left
for agreement or agreement is ok..

Or this agreement is enough & valid to send a notice to seller party
& file of court case of specific performance.
