Transfer of property

(Querist) 24 April 2012 This query is : Resolved 
My father has a residential house in his name but he is not mentaly fit & fine. Taking disadvantage of this situation my relative want to grab the said house. Whether it is the right way to transfer the same in the name of minor son by executing a gift deed in favour of son (guardian wife)? Please suggest.

has doctor ceritifed that he is suffering from mental illness . ? if he is of unsound mind how can he execute a gift deed ?

But if the interpolation of the property is imminent then you better execute the same.

If his unsoundness of mind is certified ,the need is to move for appointment of a guardian of his person and property.

Else better get the desired gift deed done in favor of the minor.

Civil court shall appoint the guardian of the property of such unsound person and that person with the permission of the court can gift the property in favour of the minor son as desired.
