Car parking for resale property

We have recently purchased a flat with which builder has given a proper car parking space alongwith the flat.The owner of the flat showed us wrong parking which did not belong to him while selling the flat and during the final agreement has not included anything abouth the parking space.He has purchased a flat in the same society and is forcefuly giving us the wrong parking which builder had not given alongwith this flat but that parking of the flat which he purchased after selling his flat to us in the same society.
He has not mentioned anything in the agreement for parking wheras builders agreement clearly mentions he cannot sell the parking.When we insisted on the parking which belonged to the flat which he sold us he has wrote aletter to society stating that he never sold a parking to us.. if thats the case why is he giving another parking.Since he is not residing in the same society he had told us to park the car in the original parking area & will make the separate agreement for parking but now he is refusing to give that parking and also not allowing to park the car there.

terms of agreement are sacrosant . agreement for purchase of flat does not mention about parking .
you have signed the agreement and has been duly registered .
the mistake you made was not appointing an advocate.
once you ahve signed on dotted line you cnanot claim parking space from seller
you have to now make application to society for allotment of car parking slot .

well advised by mr sethi, while buy the flat if he would have consult and get opinion from any lawyer then the question is not arose hear and wait for answer. Now ask yuor society to give allotment of the same by fresh and new against your application
