Rights on property earned by my grandfather.

(Querist) 04 May 2012 This query is : Resolved
Sir,

My parents have 4 children, one son (myself) and three daughters. My father got 14 Guntas (1 Gunta = 121 Sq. Yards) of residential (open) land and one old house (situated in 4 Guntas) from my Grandfather (purely earned by him the entire property).

My fahter made gift registration of 3 Guntas of land each to my three sisters at the time of their marraiges and the remaining 5 Guntas of land, out of 14 Guntas, was registered on my mother's name. Nothing was given to me.

Recently, my father expired and after that my mother asked me to dismantle the old house, which is in the name of my Grandfather only and was not mutated on his name by my father, and construct a new house. She wanted to have the house on her name. Hence, I and my three sisters (all are married) registered the house property on my mother’s name by way of release of our (4 children) rights to my mother.

Now, my mother says that I only will get rights on both properties (house property and 5 Guntas of open land, which are on her name) and not my sisters after her, when I asked to register the both properties on my name.

Sir, I want to know whether I only have legal rights over the property, which is on my mother’s name, after my mother or my sisters also can ask for share.

Expecting for early reply,

Thanking you,

your mother is owner of said property . after your father death all the children have relinquished rights in fvaour of mother . she may dispose of said property as she desires

More over you said that is in the grandfather's name , is any uncle or aunt are their?. If it is still in the name of grand father then it also prob. show all the paper related to the property to the local lawyer and follow accordingly

She is the absolute owner now.
