In our society old committee is in existence for last 5 yrs and fresh election is due for electing new committee. But the secretary is avoiding to take fresh election saying he is capable of continuing his task without election.He is managing the whole show in good manner.But few members are jealous and suspect him for corruption.Is it necessary to take fresh election for new committee.If 2/3 of members are not present for agm then can we go ahead and choose the new committee.only 6 or 7 members come for agm out 16 member society.pl advise.

yes fresh elections are necessary .
after completion of 5 year term .
you cna go ahead for AGM if 3 members remain absent . if there is no quorum adjourn meeting for half an hour

dear friend, u must insist on holding of elections which is extremely good to infuse new blood and have change of the MC. as regards agm, if there is no quorum initially, wait for an hour as per the bye laws and thereafter hold agm in the absence of quorum.

Secretary's proposal to continue without election is not legally acceptable, even if he has been managing the affairs of the society well. As per the bye laws it is his legal obligation to hold election to elect the MC within the period stipulated in the bye laws. If he fails to comply with the above requirement he and the Members of the MC will be managing the affairs of the Society at his / their personal risk as to any loss caused to the Society by their actions. The Registrar also may take action under the Coop Societies Act.

Absence of members at the GB meetings is a malady on account of which many societies are suffering. This is particularly rampant in smaller societies. Hence active members persuade other members to be present at the meeting. Very often MC members are elected by consent if no one is coming forward to file nominations for election.

If no such consensus could be worked out the secretary should approach the Registrar to appoint Administrator for the Society.
