Society bye laws

I am residing in a society consisting 48 members. The old managing committee after its tenure had initiated elections for formation of new committeea as all of them had resigned. No nominations were recieved so the old committee had co-opted new members . Is this committee legal as Bye law 116 states that the committee should be elected. Please answer

What are the bye-laws of the society.
And the moot point is are you a member of the society.

common problem faced by cooperative societes in bombay . no one wants to stand for elections . so old managing committee is declared elected . see wordings of resolution passed in AGM .

coopting of members do not entitle them rights as those of elected members. the tenure of the society MC can also be extended with approval in the AGM if no members file nomination for elections.district registrar of societies will need to be informed of this
