Property of maternal grandfather

(Querist) 28 September 2012 This query is : Resolved 
my maternal grandfather expired intestate leaving behind his two married daughters and widow. My grand mother also died thereafer intestate. Now can i claim the share in property of maternal grand father comes in hand of my mother? If my mother alive? One of my cousin sold some of aforesaid property pretaining he is the only legal heir of my maternal grand father. What action can be possible against him whether such proerty can be restored.

the 2 married daughters are the legal heirs to property on death of the parents . i presume i t was self acquired property . you have no right for any share

Dear Arun

You cannot claim the property in the live time of your mother. After your mother's demise, the said property will automatically devolve to her legalheirs. As your mother is one of the two daughters of your maternal grand father, she is entitled to one-half of the property Only.

I agree with Mr.Bhawani. Your mother can sue fr getting her share and till her life time you cannot.

If the property in question is ancestral then the right of your mother arises and the property is self acquired then no right arises. Till the lifetime of your mother you can't sue. Only your mother can sue.

At present on facts supplied only two married
daughters of your maternal grand father have right to share 1/2 and YOU DO NOT HAVE ANY CLAIM.
