is there any latest judgement of court which say post dated cheque is not come under 138 of N.I.ACT?

There is no such Judgement as it is against the law of the land buddy.

Write your specific problem. Even if there be any judgment, you being an advocate, must also be knowing that any or every judgment cannot have universal implications over all the cases of post dated cheques. Naturally, any judgment is based on the actual circumstances of the case, whereas you have not made any mention, whether you talk about issue of post dated cheque by the drawer, or presentation of the post dated cheque before the due date noted on the cheque, or return of cheque by bank if presented before the due date.

PDC is also comes under 138 NI Act, there is no specific judgement in this regard
