Agreement of property ammount not recieved but cheque is bounce

(Querist) 17 December 2012 This query is : Resolved 
dear sir we sale an our plot to person he supply the total amount Cheques for agreement in written with Cheque number but then we claim the Cheque for payments in same bank Cheques was declare bounse from bank becouse account holder(buyer) have a balance is 0 in his account now we have buy a plot on behalf of our this payment and give a token 200000, but our payment is canceled we get loss of 2 lac.
what we can do againest of cheque owner

It depends upon the terms and conditions of the sale agreement . If there is clause regarding cheque dishonoured then the agreement stands cancelled, You can cancel the agreement.If there is no such clause you have to file a cheque bounce case against the purchaser.

You have not cleared whether only an agreement was executed or a registered sale-deed was executed and registered.

In either case, you shall have to issue a notice declaring the cancellation of the agreement/sale-deed.
