Common wall dispute

(Querist) 08 January 2013 This query is : Resolved 
a 150 sq mtr house (ground floor+ first) was divided into two and was sold out to two different persons,now one portion is sold to a builder who demolished the house and now cutting 9inch common load bearing wall into half and raising construction , property in question is not pillar based structure ( certain cracks and patches are appearing in the property)
(client seeking advice after the builder has almost completed the construction of structure)
plz suggest how to stop builder from using common load bearing wall?
how to claim compensation for the damage caused to the common wall?
will a suit for declaration of common wall will serve the purpose of any future dispute as owner of second portion also wants to reconstruct?

contact a local architect and structural enginneer . obtain the report as to damage caused to your property .
then file suit for an injunction against the builder from damaging the common loqad bearing wall . also appointment of commissioner to investigate and submit report

ist you file a suit for injunction and along with file a petition for appointment of advocate commissioner, after visiting the property by the commissioner, the court will dicided.
