Saath barah

Hi
My Husband owns an 3 guntha plot in pune. Its a residential plot. we purchased this land 3 years back and did not take the saath barah 7/12 as we thought this would be transferred.
now when we tried to take a loan to build house on it and took 7/12 from talathi, it was still on previous owners name.
that person is dead and we have no idea where his family has moved to.
we have gone to talathi every week but they refuse to help us without the owner.

Please advise us what we can do.

file a writ in the high court. On the direction of the court you would get the desired document.

Generally sale deeds contain a recital that the seller shall be bound to get the name transferred in favour of the buyer in the revenue record and if he fails to do so, the buyer shall have to right to get it done at his own level so exhaust this clause, if the same is presence there.

You should make a complaint the District Revenue officer in this regard with full facts.
