Regarding propery transaction

Dear Experts,

There is one property (house) in the name of Sister & brother (1st holder Sister), now she is married and brother want to sale the property. Out of these money brother want to purchase other property on his own name.
As per above expl. have some que. as below :
1) Can brother take POA from Sister to Sale the property?
2) Can brother purchase other property out of these my on his own name?
3) Do brother required to execute any agreement from sister for relief of her share/ waiver of share in the property.

1. Yes brother can take poa
2. Since ur sister is entitle for 50% of it hence u have to part with that amount
3. If sister execute release deed in favour of brother then advice mentioned in point no.1 and 2 is need not to be followed

he has to pay sister 50%of sale proceeds .

sister can execute deed of gift in favour of brother . gift him 50% share of the property

Ajay sir pls correct me if i am wrong, whether stamp duty for gift is more when compared to release deed ???
