Minor injury on passersby

Sir,
One evening my brother had parked his Truck on the road to unload the material. The labours suddenly took out the hook of one side of the body and the body suddenly hit on one of the passerby moving on the road. The injured person was taken to nearby hospital by the truck driver where she was retain for two days. The injured person got two stitch on his head and discharged by the Hospital on third day. Now his family members are indirectly threatening to my brother saying that the hospital did not provide proper treatment and he wants to take the patient out of State for treatment and would file case against both driver and hospital. Since the patient is at his home.

Under this situation even if he opts to file case should my brother needs to go Jail as well or simply needs to pay fine in Court of Law. What would be the maximum penalty. Under which act the Police can file chargesheet in this case.

pay some compensation to the injured .find out twhat is the hospital bill . agree to reimburse thwe same . if patient refuses then let her file a case . your brother would get bail . the punishment would depnd upon the provisions of IPC your brother is charged with

Sir,
We have already paid entire hospitalisation charges. Pl suggest what would be the provision of IPC that the Police can levied even if there is nexus between the patient and Police in your opinion. And what would be the penalty thereof.

First check whether in FIR is lodged in the name of your brother or not.
Making for treatment has nothing to do with the case lodged, if any.
Do take bail first and then act as per your conscience.
