Seepage issue

(Querist) 08 May 2013 This query is : Resolved
People residing below my flat have water seepage issue in their kitchen and they believe that water seepage is happening from our house.

Knowing the fact that seepage is not happening from our house, twice we have done water proofing in our kitchen at our own cost, but still they are not satisfied.

We have observed that exterior pipe outside our kitchen grill is always damp, as there may be some crack in the pipe. This can also be reason of seepage in their house.

We have also observed couple of times that Dripping of Water in their Kitchen is high whenever we washes our kitchen grills, as the water travels from exterior wall and moves into his house. (Its my assumption) And always on the same day they comes to our house complaining about the water seepage.

Also considering our building is 35 to 40 years old this kind of seepage is bound to happen in their house.

We have submitted a letter in the society and asked them to intervene, but they have not taken any action.

They are given us treat that they will take legal action against our family and they are harassing us day in day out.

Considering this I have few question

What legal action they can take against us ?
What precaution measure should we take ? &
Can we take any legal action against them ?

1. Civil suit for mandatory injunction as well as a criminal case under section 133 Criminal Procedure code can also be filed against you.

2. Invite a technician and then get both kitchen checked in the presence of your neighbours/affected persons so that an amicable atmosphere may be created.

3. You should create amicable solution.
