House rent allowance

Respected Sir,

My query is regarding House Rent Allowance-(HRA). If Flat rental charges agreement made between Mrs. and Landlord and there is no income of Mrs. she is house wife.

Whether Husband can claim HRA or not? because
Rent is paid by Husband and not the Mrs.

Kindly advice for the same.

If the rent agreement is between your Mrs. and the landlord, only your Mrs. can claim any benefit. Whether your Mrs. has any earning capacity or not is not the question. She can beg, borrow or steel to pay the rent agreed by her.

YOU CANNOT CLAIM ANY BENEFIT, even though you may be funding. If you wanted the benefit of the agreement should flow to you, then you should have entered into the agreement with the landlord.
