Hi Experts...
I was working in a travel company and had resigned the job with immediate effect as i was on probational period(confirmation letter was not given) with handovers of Job done and company properties like ID card,FOB,in the evening when i was returning home manager took all the handovers in a rude manner,i asked him not to heart anybody like this what he did to me .he told me get lost and used bad words in the office. and i lost cant roll and had to slap him.which i admitted with my HR with the reason.on 31st head office had credited my salary and the next day they directed bank to hold my salary.and i had been to office to inquire abt my salary and explain the incident happened previous day,there i was not allowed to enter the office rather explain .kindly advice me how will i get my salary as well as my settlements.thanks in advance...

Broadly any Bank does not mark a hold in the account with out the consent of the account holder till these are the dues from the Bank or other legal necessity. You may contact the Bank for payment.
Secondly was there any notice period required for leaving the job? Have you requested in writing to leave the job and what result? If not Company can recover the notice period money.

Thanks for the reply..yes i had written resignation letter with my handover files in mail.which they read and ask for all the handovers like payments pending,DD's pending with me which i had answered for the same. they have not asked for notice period and they have scroll down the mails to the vendors and other whom we deal with saying that with immediate effect i ma no more with the company.and
regarding the salary i have got the message from bank saying salary credited to my account, when i checked in atm it says it is in ledger balance since yesterday and all my colleagues have received the salary except me please advice..

Dear Vijay
Send a legal notice to your company with all the facts and demand your salary, if they are not ready to make the payment with stipulated time then file a suit for recovery against the company.

Go to the bank and enquire real problem with your account and only then post your query.

From the facts mentioned above, the salary has been credited once in the account. No use to give notice to Company for this. Yes, you should write to Bank for removal of illegal hold in your account, if it still exist, or some other problem exist should be confirmed from the Bank.

Dear Experts,
As per your advice's i had been to the bank to inquire the reason for holding the salary.and did not get the reason they said that they need to check with their Chennai branch for the same and took my contact no and not reverted or called me.
mean time i had called my HR manager for reason for holding since two days,he was pretending as tho he was not aware on the salary hold and said that no one in accounts to find out the same.which i had called the Delhi and found the concerned person were very much there.today when we ware talking he disclosed why it is on hold and gave the reason of code of conduct (slapping the manager)and i had told him the reason and asked what he did is also comes under cod of conduct .later he asked me what will be my next step and i had told him if i don't get my hard earned money i would be going leagle to get the same.later at around 6:45 pm i got reply on my resignation mail saying resignation accepted and i need to get in touch with HR for further formalities with an advice of i could have have spoken and closed on differences rather than resorting to these improper violent behavior.Please advice and guide me what should be my reply on the mail.

I still hold the view that once the amount credited in your account, Bank has no right to hold it without valid reason. It can not debit it without your consent or under legal authority. Write & mail to Bank Branch, its Head office, customer cell, Bank's ombudsman for removal of hold. Distt. Consumer dispute redressal forum is also legal platform for such disputes.
Your resignation has been accepted. You have nothing to do with Company now. But you have slapped your senior for which you had no right. He even after bearing the slap did not drag you in criminal case. You should sincerely regret for you act.

Dear Expert..
The issue is been resolved based on my senior's brother called me and asked sorry for what happened in the office. because in the HR inquiry all my colleagues had explain the issue and said that the mistake is from my senior and supported me.hence HR requested me not to take steps where companies names gets spoiled.and also said that hold on salary will be released by today.thanks to all the experts who helped me its been a big help from you all.
