Tenant agreement

(Querist) 01 June 2013 This query is : Resolved 
If we want to give house on rent and we make agreement of 11 months and if tenant does not vacate the house, then what action we can take against him, is it punishable . I mean to say what is the strength of the agreement. What does the law permits?.
How long we can extend the agreement of 11 months to be on safer side.If we need to vacate house in the mid term say after 3 months , then can agreement be cancelled ?.
If we do not make any agreement , the what does law save from not vacating the house.

If the tenant does not vacate the house after 11 months, you shall file an Eviction Petition before the Court under the Rent Control Act. It is not punishable. The agreement establishes your rights as the landlord and the duties of the tenant and existence of your jural relationship. You may have to renew the agreement after every 11 months or even longer by registration of the same. In case you ask him to vacate in the mid-term, you shall cause a written notice to him by yourself or a lawyer (through a lawyer is a better choice) stating the reason to vacate. If there is no written agreement, then the law says the relationship of landlord and tenant has to be renewed every month.

Every state has its own Rent Laws. You have'nt stated in which state you are. Better consult a local advocate in this matter.

It is same. if tenant refuses to vacate the premises, suit for eviction of tenant is the only option.
