(Querist) 29 June 2013 This query is : Resolved
Dear Sir,
I Own a Plot of Land in the area Besa,Dabha-Nagpur
As it was Purchased in the year 1991 in my name,I have received the yearly meeting notifications till 2002.
Documents that i have are:
1)Certificate of provisionally allotment of Plot Number b-62 in that society
2)Payment receipts
3)yearly meeting notification from 1991-2002

But now the society is not willing to register that plot in my name.
Saying that everything is being sold
Now its taken over By Nagpur Improvement trust.

Kindly Guide me for the same.
What action can be taken
Will i be able to get the copensation at what rate or the property itself.
Regards,

Dear Pranay,

As regards the layout is concerned if it is demarcated by a Coop Hsg Society, you will have to approach the Co-op Registrar for the said purpose and file petition before the authority. Prior to the same get legal notice issued from a Lawyer. Pls as well verify whether the layout has been taken over by NIT as per development scheme and for what scheme it has been taken over.

You need to approach the registrar of cooperative societies of your area and to enquire in writing about the status of that society and then your status thereon and only thereafter post your query again before the experts.

You may send a legal notice to the concerned Society to cancel the Sale Deed in favour of X failing which, you may file:
1. Complaint before the Consumer Court;
2. Civil Suit for Specific Performance, Declaration of earlier Sale Deed as null and void AND for Damages against the Society.
3. Engage a good lawyer and take his services to do the above things.
