Divorce....

(Querist) 07 July 2013 This query is : Resolved
Sir/madam,

I got married to a Hindu girl against to both our parents. marriage was made on christian marriage act and issued a marriage certificate from the Church. everything on fine till a year and the actual trouble started after that and in one fine day the girl has left saying she had her brother marriage and then got absconded both her and her parents. now its almost 3yr we dont have any contact where about's of her. I havnt give any police complaint hoping she will return. now the things got changed and my hope is on verge I want to remove her name from my passport so that i can apply to overseas visa. Is there any possibility that can get a divorce from the court within days of time or priority basis. now even i dont know where she live? kindly suggest me on thing.

Thanking you all,

Joseph

Unless you get the legal decree of divorce from the family court, you cannot get the desired action. Even though you have not exact address of your wife but you can give her last known address in the petition.

It is not easy to get divorce from the court in a very short time specially when the present where about of your wife are not known. Court will take its own time and will adopt procedure as per law.

File a divorce suit in the court. You can not get the name removed from your passport with out a decree of divorce.

Dear Sir,

Thank you all for taking your valuable time in replying to my case. I'm planning to apply for the Divorce in couple of weeks. what will be the maximum time require for the court to give divorce. Since the Girl is now absconding and they are not present in the given address as well. there might be a probability of her getting married to another person. In these situation what will be duration of time required by the court to give there verdict.

Please provide some information on this.

Thanking you all,

Joseph
