Forwarding of application to other departments

Sir
Please clear my following quires:-
1. A govt.autonomous body employee whose grade pay is Rs. 7600/- is applied for lower post Rs. 6600/- in another govt. autonomous body and can department forward the same. If yes can his present services are count in new department.
2. Due to administrative reasons a govt. autonomous body decided not to forward application on deputation basis to other govt.departments in respect of their employees but the employees are applied on deputation and send their application directly to other departments. The another autonomous department call them for interview/ written exam on the basis of their advance application with the direction to produce NOC and Vigilance clearance from parent department. Now can department issued them NOC and vigilance certificate for appearing in interview/written exam.
3. One govt. department call a candidate for interview and as per his parent department he is not fulfill the essential qualification to

As a matter of policy, any department can neither forward application of an employee for deputation to some lower post than what he is holding, nor can issue NOC. Application only for higher or equivalent posts can be forwarded.

Thanks sir,
Now I want to know that if department issue NOC and vigilance clearance to an employees who have not applied through proper channel and on the basis of Interview he was selected for the post on direct recruitment basis can department relieve him.
His present pay scale in his parent department is Rs. 15600-39100 + Grade Pay of Rs. 7600.
and he is appointed in the pay scale of Rs. 15600-39100 + Grade Pay of Rs. 6600.
which is lower grade from his present grade pay .
Now can department relieve him as per rule if no under which rule if yes can his pro-rata pensionary benefits also transfer to other pensioner department .

On recruitment on the basis of direct application, you will have to resign from the present pay after giving due notice, as per rules. There is no question of transfer of prorata pensionary benefits on resignation (other than facility of technical resignation on forwarding of application through proper channel).
Moreover, acceptance of regular resignation also depends upon the discretion of the competent authority in the exigency of service.
However, if you have already rendered service of 20 years or more, you may better apply for voluntary retirement with three month's notice by virtue of which you can get pension and gratuity for the service rendered by you with additional benefit of 5 years of service.

My further query is that:-
One Group B officer wants to take voluntary retirement from the govt service with the request that he is eligible for that as per rule. His detail is given below:-
Date of birth : 16/9/1962
Age of the employee as on : 51 years
Date of Joining in govt service : 17/4/1996
(34 years)
Apply for voluntary retirement : w.e.f. Sep'2013
(total regular service 17 years)
Now he is mentioning that as per voluntary retirement rule : An employee entering in govt. job before 35 years of age, who has attained the age of 50 years or who has completed 20 years of qualifying service, may got voluntary retirement from the service, by giving a notice of not less than three months
Can due to entering in service before 35 years and cross of age of 50 years the department accept his voluntary retirement as per rule ( he is completing only 17 years regular service).

20 years of service is the minimum requirement.
Better read FR&SR along with CCS Pension Rules instead of making misinterpretation merely on your own presumption or consult some local expert to solve your unending supplementary queries. Service rules are not such to be explained in just a few words.

Sir please clarify that:
A person is appointed on deputation on absorption basis from one autonomous to another autonomous department. Can there is any prescribed period under which his deputation may be converted into absorption if the person appointed on deputation on absorption basis.

Normally one year, but subject to extension on the exigency of service.

One of our Staff members had preferred FPA claim for the tubectomy underwent some five years back ( may be in 2007 )in a private hospital. He had produced necessary certificate from the private hospital where the surgery had been done. This certificate is simply 'countersigned' by a doctor in Govt. General Hospital. The claim is delayed by five years and no valid reason is given by him for the delay. Pl. guide whether such claim can be allowed. The detail of case is
(1) In 2007 at the time of tubectomy operation he is in Navodaya Vidalaya Samiti as TGT.
(2) In 2009 he is appointed as Headmaster in Kendriya Vidalaya on direct recruitment basis.
(3) Now in 2013 he is requested to KVS to grant him special small family allowance.
Can KVS allow him the same
