Dear Hon'ble Experts
I am facing a CMP case(ie condone dealy petition) in a State Consumer commission.
the opp party filed condone delay petition. the reason for condone delay is, the records are missing in the authority so that is the reason the opp party told, with out documentry proof.
I filed a counter that there is no documentry proof for missing the records in the authority so the delay petition is liable to be dismissed.
Now i got a document proof from the authority that they did not missed any records.
Now I am having doubt is How do i add this document proof in my already filed counter statement.
do i have to file fresh Counter statement or i can file any additional counter statement?

delay is invariably condoned on payment of costs . fight on merits rather than technicalities . you can file said document along with an affidavit if you so desire

Condonation of delay petition would be allowed in spite of your hard effort unless the delay is for great period of time.
