Dear Sir,

I had filed a Petition for Restitution of Conjugal Rights U/s 9 of H.M. Act on 30.06.2009 at the Court of Civil Judge, S.D. Kalyan, Maharashtra.

The Order was Passed in favor me on 18.07.2013, saying "The respondent is directed to go the petitioner and restitute the conjugal rights with him within a period of two months from the date of this order. But my wife still not come to my house. Now I would like to take Divorce from her.

Kindly, let me know that when & how can i apply for divorce.

You have to wait till one year to apply for divorce on non compliance of decree.

After obtaining a decree of restitution of conjugal rights, if it is not complied with for one year, it may be a good ground for obtaining decree of divorce.
