Respected Sir I have lost my property (plot size 2450 Sq Ft)document. I have taken a copy of it from the concerned Sub registrar office and the registrar has signed in it. If I want to sell this property will this copy be considered as original or is there any formality? Kindly reply me sir Thanks GS Ravichandran

if you get certified copy enough, but the buyer will not buy because they doubt, so you get confirmation from the court through declaration suit, where are you from ?

Though the certified copy is an evidence as to the ownership, normally no prospective buyer will buy the property in the absence of original registered document with an apprehension that the seller might have dealt with the document before putting-up for sale To come over this difficulty you have to lodge a police complaint about the loss of original deed and also give a public notice in the local news paper that you are the owner of the property and nobody and lost the original sale deed and nobody should deal with the property basing on the original registered sale deed giving full particulars, inviting objections if any. You have to keep all this record to prove your title markatable.

The prospective purchaser may think that either property has already been sold or equatable mortgaged on the basis of original documents. The steps advised by the expert malipeddi jaggarao ji are solution to counter it.

Sir I am living in the U.A.E now. Shall I give the lost document police complaint through Indian consulate or through my lawyer in India or when I will visit India next time.Thanks Kindly reply me sir Yours G.S Ravichandran

The loss would be reported to police station in whose jurisdiction Loss was caused. FIR is a prompt action earliest the best.It has to be reported by person in whose custody the document was.

Please note all the three would be required 1.fir and police complaint. 2.news paper advt thro your advocate. 3.confirmation and declaration suit in the court where the court would endorse the copy of document obtained by you and it should be supported with up to date encumberrance certificate which should show nil encumberrance.If you are not able to attend the court your power of attorney holder who is given the power exclusively for this purpose could represent you in court.Consult your advocate.
