I need yours experts advice regarding decree for divorce case. mother's sister (aunt) living seperately from more than 20 years.CrPC 127 is going in the wardha district court against her husband. but her husband file decree for divorce case last month in Daryapur court which is in his residential juridiction. My aunt's husband was trying to get divorce before 17 years.but that time court reject his petition. my aunt's age is 56 Years & she is suffered from diabeties , blood pressure, back pain & her physical health is not good now a days. Her financial condition is not well, she have no income source. My query is can my aunt request to court for transfer this case in wardha court. Can court agree her plea.

There is a possibility of getting the transfer, you have good grounds.

Yes the case can be transferred by High Court if both the courts (district) fall within its (High Court) jurisdiction), otherwise, Supreme Court.

Yes she can apply for transfer of the case to a court near to her residence on the medical grounds.
