Sir,
The Army authorities has asked for the legal heirship certificate from court of law for the sanctioning of Family Pension of the deceased to the widow.
Do I need to file the succession certificate or suit for declaration

No, you have to apply for succession certificate.

In some states Legal heir ship certificate is issued by Tehsildar or sub divisional magistrate. Please confirm the position in your State and also confirm whether such certificate would be acceptable by Military Authorities or not.
In Military terminal benefits are released on the basis of record with them, asking for such certificate is rare.
Only the confirmation of legal heirs is required, declaration suit will solve the purpose if certificate as above is not acceptable.
