Harrasment by debt collection agency

Hi,
My Name is Rajesh Sivadas. I am writing to you as i am a victim of harassment by a debt collection agency in Mumbai.
I was unable to pay my debt due to financial problems and family obligations. I am homeless and have taken shelter with my sister with my nine month old son and wife. I have been getting phone calls from this agency in Mumbai. They want me to settle the PL account and have offered me a pay off for rupees 34100. With zero income i asked them to give me some time to arrange for the funds or to allow me to pay that in twelve installments. they are not willing to work with me and are calling my in-laws and harassing them.
This is now giving me family problems and i am going through depression. I have lost my job and am not able to find one as i am not well educated.
Please suggest what i need to do.

Though you are liable to repay the best, for these illegal acts you can bring criminal case of intimidation and defamation against the.

you can complaint against the agent , if the agency filed the case then request the court to transfer before lok adalat and settle mutually with your limit,

under no circumstances sign any letter admitting your liability to pay any amounts . record the threat issued . ask your in laws to lodge complaint against agent .disconnect your telephone . change your number

In the given facts, nothing seems like harassment. Every banker has to recover its outstanding dues. If they are calling you time and again to settle their dues, nothing is illegal.
It is better to visit the banker and settle the issue amicably. There is no legal remedy against the banker in the given facts.

In my view, Mr. Raj Kumar Makkad has given a very good opinion in your case. I agree that the bankers should not call your relatives into this issue, but howdid they get to know their phone numbers, did you give their reference while availing loan or how did this happen?
