hi guest

can you please help with complaint format need to submit it in police station.
do we have to mention section or offence n complaint?
need to file complaint of theft,breach of trust against employee who has property of company and has joined compititor..

is there any provition we can file complaint directly to court?

does your company not have legal department can it not afford legal fees?

we dont provide formats . state facts of your case , how breach is committed by employee , offence committed by employee

1. Complaint is not of form but of gist. No prescribed format.

2. Mention the factual aspects in the complaint. the police will themselves mention the provisions of law under which the offence is committed.

3. You can also file a complaint directly before the court ; of course with the help of an advocate.

Rao sir and sethi sir, i m sorry if i said something wrong..My intention was not that..I meant instaed of filing complaint to police for breach of trust can v go directly and file complaint to magistrate?

i dont want format,i need to know crpc hv option of this?

because employee has phone of company which have all details and he joined compititor.
if we file to police it will take time,thts y m saying is there any option to go directly court.. some pplsaying you cant go directly coz its abuse of police..u hv to follow procedure..first police then court..

In the complaint, you need to mention the commission of offence only, not any section.

Narrate the incidence to police in simple language, no need of quoting any section.

Complaint can be filed with the court.

The author has been misguided, please understand that it will take more time only through court with its lengthy procedures, but on a complaint with the police, the accused will be summoned, on enquiry, if he compromises and agrees to the condition, you may solve the issue very fast, choice is yours.

Thanku T. kalaiselvan ji..thanku so much..police will call or summon which u wrote? i think court issues summon..we dont want compromise,we want to teach him a lesson..can after complaint,we can file 156 (3) read with 200 or anyother procedure?

Yes, you can file either of the two but better to file one u/s 156(3) crpc.
