Dear Experts,
1)Can a Cheque bounced due to "Account Closed " from the bank not maintainable U/S 138 of N.I.Act?
2)i filed a case U/s 138 of N.I.Act for Insufficient of funds in his bank account.the case is numbered and posted for a long date. hence i filed another case for cheating th.separate proceedings with out giving complaint to the police as i am already filed a case u/s 138 of N.I.Act.The Hon,ble Magistrate returned that stating how the case is maintainable? as you are already filed the case u/s 138 of N.I.act. i filed the same through separate proceedings.the hon'ble Magistrate asking rulings regarding the maintainability but i am not able to trace.hence i request you the Experts give me the suitable advice on the above .Thank you sirs in advance.

Your advocate should be self sufficient in himself to handle your case effectively. He should not expect others to waste a lot of time free of cost in search of case-laws for him and also suggest him how the case is maintainable and he earns his fee quite easily without putting the desirable labour and time in the case on his part.
Moreover, without detailed case history/background, no suitable case laws can be found to match your case, as not all the cases are of similar nature, characteristics, background, reasons and circumstances to match with each other case.
